What It Says (Verbatim)

R 791.727 (the rule in full):

“R 791.727 Vermin and pest control plan. Rule 27. A facility shall establish and maintain a written plan for the control of vermin and pests that includes, at a minimum, monthly inspections by a trained person designated by the facility administrator.”

R 791.724, sanitation inspections:

“Rule 24. A facility shall establish and maintain written policy, procedure, and practice that require both of the following inspections: (a) Weekly sanitation inspections of all facility areas by a trained person designated by the facility administrator. (b) At least annual inspections by federal, state, or local sanitation and health officials if federal, state, or local standards are applicable.”

Definition:

“(e) “Facility” means a jail or lockup, including the buildings and site.”

What It Means in Plain Language

1. A written plan. Every jail and lockup keeps one for vermin and pests.
2. Monthly, at a minimum. The plan must include monthly inspections.
3. A trained designee, not necessarily a licensee. The inspector is a trained person the facility administrator designates. The rule does not require a licensed or contracted provider.
4. Sanitation inspections run weekly under R 791.724, with at least annual inspections by sanitation and health officials where their standards apply.

Who It Applies To

Jails and lockups under the jurisdiction of the county sheriff, which the Department of Corrections supervises and inspects under MCL 791.262.

MCL 791.262(3):

“The department shall promulgate rules and standards promoting the proper, efficient, and humane administration of jails and lockups that are under the jurisdiction of the county sheriff pursuant to the administrative procedures act of 1969, Act No. 306 of the Public Acts of 1969, being sections 24.201 to 24.315 of the Michigan Compiled Laws.”
