Standard 10.03:

“10.03 The facility has a plan for the control of vermin and pests which includes monthly inspections. If fumigations are necessary, they are done by a licensed pest control professional. (R) (Revised 12/09) (Revised 12/17)”

“Following each standard is the designation of mandatory (M) or recommended (R).”

“The facility must have met 100 percent of the Mandatory Standards and 75 percent of the recommended standards to be eligible for a Certificate of Compliance.”

What It Means in Plain Language

1. A plan with monthly inspections. The plan is the jail’s; the monthly inspection is part of it.
2. Licensed professionals for fumigation. Fumigation is reserved for a licensed pest control professional.
3. Recommended, not mandatory. 10.03 carries an (R). A jail can earn a certificate without meeting every recommended standard, but the association’s inspection still checks it.
4. Not a legal duty by its own terms. The association says the standards are not meant to establish a duty of care. A grievance or claim will still ask what the jail did about the pests.
