What It Says (Verbatim)

Rule 1400-01-.09(5):

“(5) Facilities shall provide for control of vermin and pests and shall remove inmates from treatment areas if there is a risk of illness.”

Rule 1400-01-.09(6):

“(6) Inmate housing and temporary holding area walls shall be kept clean and free of pictures or other objects which provide hiding places for vermin or create a fire hazard.”

Certification:

“Facilities that do not meet all applicable standards shall be recommended for non-certification.”

What It Means in Plain Language

1. Provide for control. The duty is the facility’s, however it arranges the service.
2. Occupant protection. Inmates are removed from treatment areas when there is a risk of illness. Utah’s standard uses nearly the same words.
3. Harborage on walls. Housing walls are kept free of objects that give vermin hiding places.
4. Certification turns on it. A facility that misses an applicable standard is recommended for non-certification after the annual inspection.

Who It Applies To

All types of local facilities (Types I through IV), which the Institute inspects annually for certification under T.C.A. § 41-4-140.

Rule 1400-01-.02(4)(a):

“All types of facilities shall comply with the applicable standards, state law and adopted rules, and the Tennessee Corrections Institute has the authority to inspect all facilities annually to verify compliance and report results of inspections to the Board of Control.”
