Kentucky Jail Standards, 501 KAR 3:080: The Jailer Shall Provide for the Control of Vermin and Pests

What It Says (Verbatim)

501 KAR 3:080, Section 1(1):

“(1) The jailer or jail administrator shall provide for the control of vermin and pests.”

Section 1(3), preventative maintenance plan:

“(3) The jailer or jail administrator shall have a written preventative maintenance plan that includes: (a) A cleaning schedule for various locations and items in the jail; (b) A schedule for inspections by the jailer or jail administrator; (c) A schedule for trash and garbage removal; and (d) A schedule for periodic inspection and maintenance of specific mechanical equipment.”

Necessity and function:

“This administrative regulation establishes procedures to provide proper sanitation and hygiene in full-service jails.”

What It Means in Plain Language

1. The duty is personal to the jailer. The jailer or jail administrator provides for control of vermin and pests.
2. No frequency and no provider. How the jail provides for it is left to the jail.
3. The maintenance plan is where a schedule would live. It must include cleaning and inspection schedules, which is the natural home for pest inspections.
4. Three tiers, same sentence. Full-service jails (3:080), restricted custody centers (7:080) and life safety jails (13:010) carry near-identical pest text.

Who It Applies To

Full-service jails, meaning jails that may house state prisoners under KRS 441.055 and meet the Chapter 3 standards. Counties that do not house state prisoners are life safety jails under 501 KAR 13:010, whose Section 8(1) carries the same duty.

KRS 441.055(1)(a)1.:

“Adopt the recommendations of the Jail Standards Commission created pursuant to Executive Order Number 81-1026 and promulgate regulations pursuant to KRS Chapter 13A establishing minimum standards for jails.”
